This insightful and stimulating book adds depth and breadth to the modern discussion among plaintiffs' attorneys about how jurys make decisions. It is written in a personal and accessible style that reflects Mr. Whitman's experience and success with jurys. It is on my trial practice shelf beside Gerry Spence, Rick Friedman, and David Ball and Don Keenan. Every plaintiffs trial lawyer should read it.
In the vast sea of books about plaintiff's trial skills, this book is a refreshing and welcome guide to preparing for trial and dealing with some of our biggest challenges. My favorite section was the "Dilemmas & Solutions" section that dealt with common problems we face, as well as specific methods of dealing with them. I also liked the discussion of "transfer of wealth." Although personal injury trials, by necessity, require the jury to take money from one party and give it to the other, Whitman focuses on it in a way that I'd not seen in other books. The descriptions of transference, authenticity, and openness are also something that all trial lawyers need to remember when presenting their cases at trial. For trial lawyers seeking to perfect their craft and obtain justice for their clients, this is a must read.
